Bicyclist Seriously Injured In Newport Beach Car Accident

A Newport Beach car accident that occurred the morning of December 9, 2009 has injured a bicyclist, according to The Orange County Register. The accident was reportedly caused by a hit-and-run driver near the street intersection of Jamboree Road and Bison Avenue. The bicycle rider, who was identified only as a man in his mid-40s, has been transported to a local trauma unit, shortly after the bicycle-car collision. The woman motorist involved in this injury crash has since been located by Newport Beach police and arrested for fleeing the scene of the accident. It is not known yet, if other charges have been filed, as the investigation is ongoing.

Hit-and-Run Car Accident

I extend my deepest sympathies to the injured victim of this hit-and run crash. This is truly a tragic event for the family and friends of this injured bicyclist. I wish the victim my very best for a speedy and full recovery. I would also like to commend the Newport Beach police for their outstanding work in finding the suspect so quickly. This is the sort of action that is needed to deter hit-and-run drivers.

The news account still does not provide a complete picture as to what exactly happened in this bicycle accident. I’m however, relieved this hit-and-run suspect has been held. If she is found to be responsible for causing this accident and the injuries to the bicyclist, she should be prosecuted to the fullest extent of the law. California law clearly states that hit-and-run driving is a crime and a violation. Any motorist who is involved in an accident, whether it is their fault or not, are required by law, to stop, and provide assistance if necessary, and exchange information. California Vehicle Code section 20001 states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.” Considering the extent of the bicycle rider’s injuries here, the woman driver may face felony hit and-run and other additional criminal charges.

How a Personal Injury Attorneys Can Help

In many of these cases, bringing the hit-and-run suspect to trial is only the beginning step. For the victims and their families, their pain, loss and damages incurred deserve to be compensated. The negligent party or parties should also be held civilly responsible in a serious injury accident to provide compensation to the victims. In our experience, hi-and-run driving is symptomatic of other negligent actions, including DUI, not having a valid driver’s license, not carrying required car insurance etc. The family of this bicyclist would be well served in consulting a Newport Beach personal injury lawyer, who will better explain their legal rights and options to them.

A knowledgeable car accident lawyer will also determine how the victim’s car insurance policy applies to a situation involving a hit-and-run driver or one where the at-fault party lacks insurance or is under-insured. The lawyer should then explain to victims and their families how a claim for compensation may be filed through their own auto insurance coverage.
