Bicyclist Critically Injured in Garden Grove Hit and Run Crash

A bicyclist was hospitalized in critical condition the morning of March 3 after he suffered major injuries in a Garden Grove car accident involving a suspected hit and run driver. According to a news report in The Orange County Register, the incident occurred at the intersection of Orangewood Avenue and Euclid Street on the night of March 2 and found the bicyclist with major head trauma. He was transported to a hospital for treatment.

They arrested a 26-year-old suspected drunk driver identified as Victor Medina a short distance away. He was arrested on suspicion of felony hit and run and driving under the influence. Police said the bicyclist had the right of way. Officers located the suspect’s vehicle a quarter mile away and the driver was taken into custody after he showed signs of impairment, police said. The Chevy Suburban that struck the bicycle had heavy front-end damage, officials said. Anyone who witnessed the crash is asked to contact Garden Grove Police at 714-741-5823.

Our thoughts and prayers are with the injured bicyclist. We wish him the very best for a speedy and complete recovery.

Violation of Laws

Based on this news report, it appears that the driver of the Chevy Suburban may have not only violated the right of way, but also may have operated his vehicle under the influence and left the scene of a major injury collision. Under California Vehicle Code Section 23152 (a), it is illegal to operate a motor vehicle while under the influence of alcohol and/or drugs.

California Vehicle Code Section 20001 (a) requires motorists to stop right away at the scene of a crash and remain at the scene until the authorities arrive. Drivers are also required to exchange pertinent information with other parties such as driver’s license, auto insurance details, etc. and most importantly, obtain help for the injured victim.

Protecting Victims’ Rights

In this particular case, the injured victim can file a personal injury claim against the at-fault driver’s auto insurance policy. Injured victims can seek compensation for damages such as medical expenses, lost income, hospitalization, cost of rehabilitation, permanent injuries, disabilities, pain and suffering and emotional distress. An experienced Orange County bicycle accident lawyer will be able to stay abreast of the official investigation and ensure that their legal rights and best interests are protected.
