A 60-year-old man died from his injuries suffered in a hit and run crash in Fullerton. According to a news report in The Orange County Register, the fatal crash occurred at Lemon Street and Santa Fe Avenue on the evening of Jan. 2. Police found the victim lying in the number two lane of Lemon. The initial investigation determined that the suspect vehicle, a 2015 Honda Civic, was traveling south on Lemon when it struck the pedestrian. Paramedics transported the victim to a hospital. He was pronounced dead at the hospital.
The driver of the Honda, who was identified as 43-year-old Marianne Hall, left the scene before officers arrived. But she later returned to the scene and was arrested on suspicion of felony hit and run causing great bodily injury or death. Police do not believe alcohol or drugs were a factor in this crash. Anyone who witnessed this collision is asked to call Fullerton police at 714-738-6812.
We offer our deepest condolences to the family members of this deceased victim for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.
What the Law States
Based on this news report, it appears that the pedestrian may have been walking outside a marked crosswalk at that intersection. However, the law states that drivers should exercise due care and should look out for the safety of pedestrians, even when they are not walking in a crosswalk. In this case, the driver struck the pedestrian and then left the scene of what was a fatal accident. This is a violation of California Vehicle Code 20001 (a).
Under the law, motorists are required to stop immediately at the scene of the crash and wait for officials to arrive at the scene. Drivers are required to stop regardless of whose fault the accident was. Motorists can expect to be arrested and charged with felony hit and run even if they return to the scene later because the law requires them to stop right away, stay until officials arrive, and get medical attention for the injured victim even if that means calling 911 on their cell phones.
Justice for Victims
Injured hit and run victims or families of deceased victims would be well advised to contact an experienced Orange County hit and run lawyer who will remain on top of the official investigation and help ensure that their legal rights and best interests are protected. A knowledgeable attorney will also be able to help victims and families explore other avenues of compensation, which could be invaluable during such a time.
