Motorcyclist Killed in Orange County Car Accident

Kenneth Brant, 61, was killed in an Orange County car accident after his motorcycle was struck head-on by another vehicle. According to a news report in The Orange County Register, the fatal motorcycle accident occurred on the Ortega Highway near Lake Elsinore, the morning of November 28, 2010. Brant was travelling east on the highway when a 1980 BMW heading west hit him head-on.

Brant died from his injuries. The driver of the BMW, who has not been identified, also suffered injuries. California Highway Patrol officials are considering filing manslaughter charges against him. Investigators say drugs or alcohol do not seem to be involved, but are not sure what caused the driver of the BMW to cross over into opposing lanes of traffic.

My heartfelt condolences go out to the family and friends of Kenneth Brant. My thoughts and prayers are with them following this horrific motorcycle accident.

Orange County Motorcycle Accidents

According to CHP’s 2008 Statewide Integrated Traffic Records System (SWITRS), three people were killed and 49 were injured due to motorcycle accident that occurred in the unincorporated areas of Orange County. During the same year, there were 35 fatalities and 801 injuries reported as a result of motorcycle accidents in all of Orange County.

What Caused This Tragic Motorcycle Accident?

Based on this news report, officials are not yet clear what caused the driver of the BMW to drift into opposing lanes of traffic. However, it appears they suspect recklessness or negligence on the part of the driver. According to California Vehicle Code Section 21651 (a): “Whenever a highway has been divided into two or more roadways by means of intermittent barriers or by means of a dividing section of not less than two feet in width, either unpaved or delineated by curbs, double-parallel lines, or other markings on the roadway, it is unlawful…to drive any vehicle over, upon, or across the dividing section.”

Liability Issues

In cases where negligence or wrongdoing is involved, the family of a deceased car accident victim can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. If the driver of the BMW is determined to have been at fault, he could not only face criminal charges, but can also be held civilly liable. An experienced Orange County motorcycle accident lawyer will be able to better advise families about their legal rights and options in such cases.
