San Bernardino Car Accident Proves Fatal for Motorcyclist

Timothy Denzler, 19, was killed in a San Bernardino car accident after his motorcycle was struck by a vehicle at a street intersection. According to a news report in The San Bernardino County Sun, the fatal motorcycle accident occurred the night of October 10, 2010 at the intersection of Milliken Avenue and Church Street in Rancho Cucamonga. Denzler rode into the intersection as the light turned green and struck a Toyota Corolla driven by 22-year-old Vanessa Fiorenza, which was turning left at the intersection. Denzler was thrown off his motorcycle and sustained fatal injuries.

I offer my deepest condolences to the family and friends of Timothy Denzler for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.

Motorcycle Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were two deaths and 32 injuries involving motorcycle accidents in Rancho Cucamonga. In San Bernardino County, 34 people died and 532 were injured as a result of motorcycle accidents during the same year.

Left turn Law

Based on this news report, Denzler had the green light at the time and Fiorenza was making a left turn. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”

Compensation Issues

I trust officials are also looking into whether the driver of the Corolla was speeding, driving recklessly, or distracted at the time. If she is determined to have been at fault, then she could be held liable for Denzler’s wrongful death. In cases where negligence or wrongdoing is involved, the family of a deceased car accident victim can file a wrongful death claim seeking compensation for medical and funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced San Bernardino personal injury lawyer will be able to better advise victims’ families about their legal rights and options.
