A man who was fatally injured in a San Bernardino car accident the morning of August 3, 2010, has been identified by officials as 21-year-old Luke Eller. According to a news report in The San Bernardino County Sun, the 2010 Mazda in which Eller was a passenger went out of control on Lone Pine Canyon Road, rolled over and crashed. The driver of the Mazda, 20-year-old Daniel Sigala, left the scene of the crash. Eller, who was partially ejected from the vehicle, was transported to a local hospital where he was pronounced dead. An investigation is ongoing.
I offer my heartfelt sympathies to everyone who knew and loved Luke Eller. Please keep this grieving family in your thoughts and prayers.
Deadly Rollover Crashes
According to the National Highway Traffic Safety Administration (NHTSA), there are about 40,000 traffic accident fatalities in the United States each year. About 25 percent or nearly 10,000 fatal car accidents are rollover accidents, the NHTSA reports. Rollover crashes often result in catastrophic injuries or deaths because of the intensity with which they occur.
Possible Auto Product Liability Issues
I trust officials are looking into the various factors that caused this tragic accident in the first place. I would be interested to find out how or why Eller got ejected from the vehicle. If the details of this news report are accurate, both Eller and Sigala were buckled up at the time of the collision. Were Eller’s fatal injuries caused by seatbelt defects? Did his seat restraint system fail causing him to be partially ejected from the vehicle?
If Eller’s fatal injuries were, in fact, the result of seatbelt failure, then, the auto maker and the manufacturer of the defective seatbelt could be held liable for his wrongful death. In such cases, families of deceased victims could file a claiming seeking compensation to cover medical or funeral expenses, lost future earnings, loss of love and companionship, and other related damages. An experienced San Bernardino personal injury lawyer who has successfully handled auto product liability lawsuits will be able to advise victims’ families about their legal rights and options.
