Laws Relating to Pedestrians
Motorists have a duty of care to yield the right of way to pedestrians who are crossing the roadway. Under California Vehicle Code Section 21950 (a), motorists are required to come to a stop at a crosswalk – whether it’s marked or unmarked – and yield the right of way to the pedestrian.
Even when a pedestrian is not walking in a crosswalk, drivers have the duty to operate the vehicle carefully. California Vehicle Code Section 21954 states: “Every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard.” The same section also states: “The provisions of this section shall not relieve the driver of a vehicle from the duty to exercise due care for the safety of any pedestrian upon a roadway.”
If you have lost a loved one in a pedestrian accident, you may be able to seek compensation for your losses by filing a wrongful death lawsuit. Families of deceased victims may be able to seek compensation for medical expenses, funeral costs, lost future income, pain and suffering and loss of love, care and companionship. A knowledgeable Santa Ana pedestrian accident lawyer will also be able to determine whether the collision was caused by a dangerous or defective roadway. In such cases, the governmental agency responsible for maintaining the roadway can also be held liable.
