Zicam Class Action Suit Pending in California? Zicam Defects Surfaced Five Years Ago

California Zicam class action attorneys are aware that the problem with Zicam intranasal cold remedies is nothing new. According to an investigative news report done by Denver’s 7News in 2004, five years before the U.S. Food and Drug Administration (FDA) cautioned consumers that use of Zicam can result in the loss of sense of smell. In 2004, Matrixx Initiatives, the manufacturer of Zicam, admitted that they did not know if their nasal gel could cause loss of smell.

We now know that hundreds if not thousands of consumers, who have used the nationally advertised and marketed Zicam cold remedies have suffered personal injury, primarily loss of their sense of smell–either with just one single use or with multiple uses of Zicam cold spray or cold gel. This news report five years ago said the FDA had already received hundreds of Zicam complaints. Doctors at the University of Colorado Taste and Smell Clinic also saw an increasing number of patients who said they lost their sense of smell after using Zicam intranasal gel, which contains zinc gluconate.

Zicam lawsuits began piling up in several states. All along, Matrixx Initiatives has said the product was safe, but it wasn’t until five years ago that company officials admitted that they didn’t know for a fact that the product was safe! They had not performed any studies or tests that could prove Zicam products were safe. Five years ago, company officials disclosed in a filing to the Securities and Exchange Commission on issues affecting stockholders that there was “insufficient evidence at this time to determine if zinc gluconate, when used as recommended, affects a person’s ability to smell.” Still, the company did not remove Zicam products from the market pending additional study. They didn’t even warn consumers despite getting a flood of complaints from consumers who had used the product and had lost their ability to smell.

It is disgusting that Zicam acted with such callous disregard toward consumers. Despite knowing that their products were injuring consumers or had the potential to injure consumers, they not only continued to market them as effective cold remedies, but also did not make any effort to warn users about possible adverse drug effects. They simply didn’t care that these defective products could destroy someone’s quality of life or put them in a dangerous situation. There is no question in my mind that the manufacturer of these defective Zicam products should be held liable for the grief and damages they have caused hundreds of consumers nationwide over the last several years.
