A woman was injured in an Orange County car accident after she was hit by a vehicle, while walking in a marked crosswalk. According to a news report in The Orange County Register, the pedestrian accident occurred at the intersection of Crone Avenue and Loara Street in Anaheim, the morning of September 6, 2011. The woman was crossing the road when a Toyota Corolla making a left turn struck her. The woman was taken to UCI Medical Center with unknown injuries. The driver told officials that the rising sun had temporarily blinded her. It is not clear if the driver of the Toyota will face charges.

Pedestrian Accident Statistics
According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), eight people were killed and 101 were injured in Anaheim pedestrian accidents. During that same year, there were 41 fatalities and 864 injuries reported involving Orange County pedestrian accidents.
The Laws Relating to Pedestrians
Based on this news report, it appears that the driver failed to yield the right-of-way to a pedestrian who was walking in a marked crosswalk. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.”
The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.” Although the woman claimed that the sun was in her eyes, I trust officials are looking into whether she was distracted, inattentive or otherwise negligent at the time.
