Cynthia Guerra, 30, was killed in a San Bernardino car accident after the minivan she was driving was hit head-on by another vehicle. According to a news report in The San Bernardino Sun, Guerra was driving a 2004 Nissan Quest minivan the afternoon of June 7, 2010 on Highway 395 near Eucalyptus Street, in Victorville. San Bernardino County Coroner’s officials report that a 2005 Chevy Silverado pickup truck drifted from a nearby lane and crashed into Guerra’s van. She was airlifted to an area hospital where she died shortly after the crash. An investigation is ongoing.

Car Accident Statistics

What Caused this Fatal Collision?
There is no information in this news report about the other driver. According to officials he drifted over to opposing lanes of traffic causing the fatal head-on collision. There are many questions here. Was the driver of the pickup truck under the influence? Did he or she fall asleep at the wheel? Was the driver distracted, driving recklessly or otherwise negligent at the time of the collision? I trust officials are looking into these and other factors in order to determine whether there was any negligence or wrongdoing here.
Claim for Compensation
If the driver of the pickup truck here is in fact determined to have been at fault, he or she could be held liable for Guerra’s wrongful death in addition to facing criminal charges. Where there is negligence or wrongdoing involved, families or deceased car accident victims could seek compensation from the at-fault party for funeral expenses, lost future earnings, loss of love and companionship, and other related damages.
Families of deceased victims in such cases would be well-advised to contact an experienced California personal injury lawyer, who will stay abreast of the investigation and make sure that their legal rights and best interests are protected. A knowledgeable car accident lawyer will also be able to advise victims or their families about how their own car insurance policy applies to a case where the at-fault party is uninsured or underinsured.
