What can we do to curtail lawsuit abuse?

If a doctor performs a surgery on the wrong place on a patient and when he discovers his error, admits to his patient that he made an error, does the doctor, the doctor’s attorney and the doctor’s insurance company then deny any wrongdoing and refuse to compensate the patient for the mistaken surgery? You would certainly think not. The doctor clearly makes an error, does the right thing and admits it to his patient (how could he do anything else since it operated on the wrong portion of the body?), he surely isn’t going to deny the facts when it comes to compensating his patient, is he?

Two Mendocino County animal control officials were injured in a dog bite incident even as they responded to reports of vicious pit bulls chasing people in a local neighborhood the morning of April 9, 2010. According to an article in Lake County News, the county sheriff’s officer received a 911 call from neighbors who said they were being chased by the dogs near the intersection of Laughlin Way and North State Street in Redwood Valley.

A 42-year-old Riverside woman was killed in a fiery Los Angeles car accident the night of April 12, 2010 on the 5 Freeway in Glendale. According to a news report in the Daily Breeze, the crash occurred in the southbound lanes of the freeway near Glendale Boulevard. Three people were taken to area hospitals with major injuries. The woman who later died was in cardiac arrest. A 35-year-old man was in serious condition with a possible head injury and burns. A girl, about 6 years old, suffered burn injuries to her legs. Preliminary reports from California Highway Patrol officials indicate that a vehicle may have stalled and was struck by another vehicle. An investigation is underway.

I offer my deepest condolences to the family of the deceased victim in this crash for their tragic and devastating loss. My heart also goes to the man and the little girl who were seriously injured. Two people were fatally injured in a car accident the morning of April 10, 2010 after their vehicle was hit by a suspected drunk driver on Highway 41 in Kings County. According to a news report in the Visalia Times Delta, police arrested Ruben Lopez, 65, in connection with the fatal car collision that killed two persons, ages 87 and 63. California Highway Patrol officials say Lopez was driving a 1994 Chevy Silverado south on the highway, near Newton Avenue, when the vehicle entered the northbound lanes. The Chevy then, struck the left front end of an oncoming 1997 Pontiac Grand Am. Both the occupants of the Grand Am died at the scene. Lopez sustained major injuries and was arrested on suspicion of felony driving under the influence.

I offer my heartfelt condolences to the family of these two people who were killed because another driver chose to drink and drive. Tragic! Please keep their grieving family members in your thoughts and prayers.

Emily Rose Shane, 13 was killed in a Los Angeles car accident after being hit by a car while walking down Pacific Coast Highway, in Malibu, on April 3, 2010. According to an ABC news report, Emily was walking in the 29000 block of Pacific Coast Highway, when a Mitsubishi Lancer, driven by 26-year-old Sina Khankhanian, struck her. Police say Khankhanian, minutes earlier, deliberately crashed his car into a power pole. The collision caused the sport utility vehicle to roll over and strike the girl. Khankhanian has been arrested on suspicion of murder, but officials do not believe he intentionally hit Emily.
