DUI Suspected in Fatal Los Angeles Crash

A Pasadena man has been accused of drunk driving in connection with a car accident in Los Angeles that killed a 4-month-old girl and injured a 10-year-old boy and a woman on the 110 Freeway in Elysian Park. According to a news report in the San Gabriel Valley News Tribune, 26-year-old Jared Silvestri was allegedly under the influence when the crash occurred on the northbound 110 Freeway just south of the 5 Freeway. California Highway Patrol officials said Silvestri was at the wheel of a 2001 Chevrolet when it slammed into the rear of a 2006 Chrysler that was slowing and pulling over to the right shoulder.

Tragic Collision

A 48-year-old La Crescenta woman and the children who were inside the Chrysler were all hospitalized with injuries. The infant girl succumbed to her injuries. The woman and the boy sustained “moderate” injuries. Officials said the Chrysler had pulled halfway onto the right shoulder when it was struck from behind by Silvestri’s car at a high rate of speed. Silvestri was arrested on suspicion of driving under the influence and is expected to be charged with vehicular manslaughter.

Driving Under the Influence

Based on this news report, it appears that the driver, Silvestri, was under the influence of alcohol when he rear-ended the Chevrolet at a high rate of speed and caused this fatal crash. Under California Vehicle Code Section 20001 (a), it is illegal to operate a vehicle while under the influence of alcohol and/or drugs. It is also against the law to drive with a blood alcohol concentration (BAC) of 0.08 percent or higher.
