Wesley Davis, 23, was killed in an Anaheim car accident after his car was hit by an SUV, the night of July 29, 2011. According to a news report in The Orange County Register, the fatal car crash occurred at the intersection of La Palma and Sequoia avenues. Authorities report that Davis was turning left at the intersection when a Ford Explorer SUV struck his Buick. The Buick was sheared in half by the impact and the Explorer overturned. Davis was killed, while a female passenger in the Buick and the male driver of the Explorer were hospitalized with non-life-threatening injuries. The cause of the crash remains under investigation.
My heart goes out to the family and friends of Wesley Davis following this tragic car accident. My thoughts and prayers are with them during this difficult time.
Car Accident Statistics
According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), 23 people were killed and 1,970 were injured in Anaheim car accidents. During that same year, 141 fatalities and 13,373 injuries occurred due to Orange County car accidents.
What Caused This Fatal Car Crash?
Based on this news report, it appears that Davis was making a left turn at the intersection when the crash occurred. At this point, it is not clear which driver had right-of-way at the intersection. Did Davis have a green arrow, or, did both drivers have the green light? If Davis had the green arrow, he had the right-of-way. However, if both drivers had the green light, then, the driver turning left must yield right-of-way to the oncoming vehicle, under California Vehicle Code Section 21801. I trust officials are also looking into whether speed, alcohol or recklessness caused or contributed to this fatal crash.
Liability Issues
In fatal accidents where negligence or wrongdoing is involved, the family of a deceased victim can file a wrongful death claim seeking compensation for damages including medical expenses, funeral costs, lost future income, loss of love and companionship, and other related damages. Victims’ families would be well-advised to contact an experienced Orange County personal injury lawyer, who will analyze all facets of the incident and ensure that the negligent parties are held liable for their actions.
