Causes and Liability Issues
This report does not specify what caused this accident. However, the news report does state that the collision occurred at a street intersection. There are several unanswered questions here. Did one of the drivers fail to yield right-of-way? Did either the bus driver or the driver of the delivery truck run a red light at the intersection? Was one of the drivers impaired, speeding, distracted or driving recklessly?
According to California Vehicle Code section 21800 (a): “The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.”
If it is determined that the bus driver’s negligence caused this accident, the passengers who were injured could file a claim against the transit authority seeking compensation for medical expenses, loss of wages, hospital costs and other expenses related to the accident. If the driver of the delivery truck is determined to have been at fault, then, both the driver and his or her employer could be held financially responsible for the injuries and damages. An experienced Los Angeles personal injury lawyer will be able to advise victims in such cases about their legal rights and options. Please remember that personal injury victims only have six months to file a claim against a public entity under California Government Code section 911.2.
