Rights of Pedestrians
Based on the news report, it appears that this pedestrian accident occurred near the intersection of Chapman and Clarke avenues. It is not clear if the victim was walking in a marked or unmarked crosswalk at the time. California Vehicle Code 21950 (a) requires motorists to stop and yield the way to pedestrians walking in marked or unmarked crosswalks.
California Vehicle Code 21954 states that while pedestrians who are not walking within marked or unmarked crosswalks should yield the right of way to vehicles, drivers also have a responsibility to look out for pedestrians who may be attempting to cross the freeway.
