Pedestrian Critically Injured in Orange County Car Accident

By

Tzu Tseng Wang, 89, is in critical condition after being injured in an Orange County car accident the morning of October 28, 2010. According to a news report in The Orange County Register, the major injury pedestrian accident occurred at the intersection of Orangewood Avenue and Los Alamitos Boulevard in Los Alamitos. Authorities say Wang was using the crosswalk when a Honda Civic struck him. Wang suffered multiple injuries to his head, legs and hip. It is not clear if the 60-year-old driver will be cited for the accident. An investigation is ongoing.

My thoughts and prayers are with Tzu Tseng Wang and his family following this tragic accident. I wish him the very best for a speedy and complete recovery from his serious injuries.

Orange County Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), there were no fatalities, but two injuries reported as a result of Los Alamitos pedestrian accidents. In Orange County as a whole, 31 people died and 785 were injured as a result of pedestrian accidents in 2008.

Laws Relating to Pedestrians

It is unclear what caused the 60-year-old driver to crash into Wang or why he did not see the pedestrian in the marked crosswalk. California law requires motorists to yield right-of-way to pedestrians in marked or unmarked crosswalks. According to California Vehicle Code Section 21950 (a): “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Protecting Victims’ Rights

Victims of pedestrian accident often sustain serious injuries that require extensive medical treatment. In such cases, it is in the best interests of injured victims to contact an experienced Orange County personal injury lawyer who will protect their rights while holding the at-fault driver civilly responsible for the car accident. Injured victims can seek compensation to cover medical expenses, loss of earnings, hospitalization, rehabilitation and even the cost of long-term care in case of catastrophic injuries.
