Car Accident Statistics
According to the California Highway Patrol’s Statewide Integrated Traffic Records System (SWITRS) there were two fatalities and 127 injuries involving car accidents in San Jacinto in 2008. During the same year, 220 people lost their lives and 8,561 people were injured in car accidents in Riverside County.
Right-of-Way Laws
At this time it is unclear who was at fault for this major injury car collision. California law requires drivers making left turns to yield right-of-way to oncoming vehicles. California Vehicle Code Section 21801 (a) states: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
Liability Issues
If the female driver of the Kia made an unsafe left turn, then she could be held liable for the accident and injuries caused to the driver of the Chevy and his young son. If it is determined following an investigation that she had the right-of-way, then the driver of the Chevy can be held liable for the injuries and damages sustained by the female driver. An experienced Riverside personal injury lawyer will be able to advise victims and their families about their legal rights and options in such cases.
