San Diego Car Accident Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 90 people were killed and 2,252 were injured as a result of car accidents in unincorporated areas of San Diego County. During that same year, there were 246 fatalities and 13,527 injuries due to car accidents in San Diego County.
What Caused This Car Accident?
Based on this news report, it is not quite clear how or why this rollover accident occurred. There are several unanswered questions here. Was there an auto defect or mechanical malfunction in Birse’s pickup truck? Was there a design flaw, which may have caused the truck to roll over? Was there a dangerous roadway condition, which may have caused Birse to lose control of the vehicle? Were there any other vehicles involved? For example, did Birse get cut off by another driver or run off the roadway by another vehicle? I trust officials are looking into these and other issues in order to determine precisely what caused this fatal crash.
Liability Issues
If a vehicle defect is determined to have been responsible for this accident, the auto maker could be held liable for the victim’s wrongful death. If a dangerous roadway condition caused or contributed to the accident, then, the governmental entity responsible for maintaining that roadway could be held liable. Under California Government Code Section 911.2, any personal injury or wrongful death claim against a public entity must be filed within six months of the incident. An experienced San Diego personal injury lawyer will be able to better advise families of car accident victims about their legal rights and options.
