Is this a Job Injury?
Based on this news report, it is not clear exactly how or why this fatal accident occurred. We do not know whether Jose Villaneuva was a passer-by who was helping the dump truck back up or a city employee who was on the job. If he was employed by the city then Villaneuva’s family would be entitled to receive California worker’s compensation benefits. They might also want to look into filing a third-party claim. Such claims are usually filed in serious job injury cases, where the injuries were caused by the negligence of a third party (one other than an employer) such as a contractor, sub-contractor or manufacturer of a defective product.
If Villaneuva was not an employee, but just a passer-by who was asked by the dump truck driver to help out, then the city could be held liable for the accident and resulting fatal injuries. California Government Code requires that any claim against a governmental agency be filed within 180 days of the accident or injury.
