Two Pedestrians Injured in Orange County Car Accident

By

Two pedestrians sustained serious injuries in an Orange County car accident after they were struck by a car at a street intersection. According to a news report in The Orange County Register, the pedestrian accident occurred at the intersection of Gilbert Street and Cerritos Avenue in Anaheim the night of October 31, 2010. The two pedestrians were crossing Cerritos at Gilbert when a silver Honda turned left and struck them. The pedestrians were transported to a local hospital for treatment. They have been listed in stable condition.

My thoughts and prayers are with the injured pedestrians involved in this Anaheim car accident. I wish them both a complete and speedy recovery from their injuries.

Pedestrian Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), one person was killed and 73 were injured in Anaheim pedestrian accidents. In Orange County as a whole, 31 fatalities and 785 injuries were reported as a result of pedestrian accidents during the same year.

The Law Relating to Pedestrians

California law requires motorists to yield right-of-way to pedestrians in crosswalks — marked or unmarked. California Vehicle Code Section 21950 states: “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection.” The same section also states that the driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk “shall exercise all due care and shall reduce the speed of a vehicle or take any other action relating to the operating of the vehicle as necessary to safeguard the safety of the pedestrian.”

Liability Issues

I trust officials are looking into what caused the driver of the Honda to turn left as the pedestrians were crossing the intersection. Was the driver impaired, distracted, inattentive, speeding or otherwise negligent at the time? If the driver is determined to have been at fault, he or she could be held responsible for the injuries caused in this case. Injured victims in such cases would be well-advised to seek the counsel of an experienced Orange County personal injury lawyer, who will analyze all facets of the incident and ensure that the at-fault parties are held liable for their actions.
