Adriana Nicanor, 29, was critically injured in a Ventura car accident when she was ejected from the vehicle in which she was a passenger. According to a news report in the Ventura County Star, the single vehicle accident occurred on Highway 101 near Victoria Avenue in Ventura, the morning of May 16, 2011. Ricardo Avila, 24, was driving south when his car veered off the roadway, entered the shoulder and struck a concrete wall. Nicanor was ejected from the car as it rolled over numerous times after hitting the wall. She suffered critical head injuries and Avila sustained a cut to his finger. Avila was later arrested on suspicion of driving under the influence.
My thoughts and prayers are with Adriana Nicanor following this DUI collision. I wish her the very best for a complete and quick recovery.
Ventura County DUI Statistics
According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), two people were killed and 63 injured as a result of alcohol-related crashes in Ventura. During that same year, Ventura County DUI collisions claimed 27 lives and injured 475 people.
California Drunk Driving Laws
Based on this news report, it appears that the driver, Avila, was under the influence at the time. It is illegal under California law to operate a motor vehicle under the influence of alcohol and/or drugs. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” The same section also states that it is illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of 0.08 percent or higher.
Liability Issues
Victims of drunk drivers may pursue compensation for their losses by filing a personal injury claim. In such cases, compensation may be available for losses including medical bills, loss of wages, cost of hospitalization, rehabilitation and other related damages. In this particular case, if Nicanor was ejected from the car due to a defective seatbelt, the auto maker or the manufacturer of the defective seat restraint system can also be held liable. An experienced Ventura personal injury lawyer will better advise car accident victims about their legal rights and options.
